Residency Requirements
One of the things you must consider if you are considering a divorce in California is the state’s residency requirements. If you have moved to Oceanside recently from out of state or from elsewhere, you may not be able to file as simply as you might assume. The following are a few of the pertinent residency requirements:
- It is NOT necessary that you were married in California to divorce in the state.
- However, you and your spouse must have resided in California for the previous six months.
- You must also have been in your current county for at least three months. This is the county that will handle your divorce.
- If you and your spouse have been in separate counties, each residing there for at least three months, you may divorce in either county.
